It’s all about the labeling! According to Forbes, a woman is suing Jelly Belly over the sugar content in their Sport Beans Energizing Jelly Beans.
Jessica Gomez is upset because the candy contains more sugar than she thought. The term ‘evaporated cane juice’ is listed on the ingredients instead of the word sugar. She claims the label has mislead consumers.
“By so doing, defendant is able to deceive consumers, including plaintiff, regarding basic nature of the product and its contents,” the complaint states.
Jelly Belly says all she had to do was read the nutritional label which shows the sugar content.
“This is nonsense,” the company said. “No reasonable consumer could have been deceived by Sport Beans’ labeling – Gomez could not have seen ‘evaporated cane juice’ without also seeing the product’s sugar content on its Nutrition Facts panel.”
The company has filed a motion to dismiss the case.
